Terms of Service

Please read these Terms of Service ("Terms") carefully before using MyCardBatch ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

MyCardBatch is a web-based tool that helps sports card and Pokémon card sellers create eBay listings using AI image scanning. Listings can be published directly to eBay through the eBay API or exported as an eBay-ready CSV file. The Service is offered on a credit-based model: free Card Upload credits are granted once you verify your email address, with additional credits available for purchase.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service you represent that you meet this requirement and that any information you provide is accurate.

3. Accounts

You are responsible for maintaining the security of your account credentials.
You may not share your account with others or create multiple accounts for the purpose of obtaining free credits.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Credits

Card Upload credits are purchased in packs. All purchases are in US dollars.
Credits are non-transferable and have no cash value.
Refund policy: Credits that have not been used may be refunded within 7 days of purchase by contacting us at [email protected]. Credits that have been partially or fully used are non-refundable.
Pricing is subject to change. We will provide notice before price changes take effect.

5. Image Uploads and Storage

Card images you upload are retained while the associated card is active in your account. Images for cards that have sold are automatically deleted approximately 90 days after the sale.
You retain ownership of images you upload. By uploading, you grant us a limited licence to process and store the images solely to provide the Service.
You may not upload images that you do not have the right to use, or that contain illegal content.

6. AI-Generated Content

The Service uses AI to extract card details from images. AI results are not guaranteed to be accurate. You are responsible for reviewing and verifying all generated listing data before submitting it to eBay or any other platform.

7. Prohibited Use

You agree not to:

Use the Service to generate listings for counterfeit, stolen, or misrepresented cards.
Attempt to reverse-engineer, scrape, or otherwise circumvent the Service.
Use automated tools to consume credits or make API calls beyond normal usage.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uptime, accuracy of AI results, or compatibility with any third-party platform including eBay. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, MyCardBatch and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost profits, listing errors, or account suspension by third-party platforms.

10. Intellectual Property

The MyCardBatch name and logo, the Service's software, design, text, and other original content are the property of MyCardBatch and its operators and are protected by trademark, copyright, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.

MyCardBatch is an independent tool and is not affiliated with, endorsed by, or sponsored by eBay Inc., The Pokémon Company, Nintendo, Panini, Topps, Fanatics, or any sports league, players' association, or card manufacturer. All third-party names, trademarks, logos, set names, and brands referenced in the Service are the property of their respective owners and are used only for descriptive and identification purposes (nominative fair use) to help you accurately describe the cards you list.

Card images you upload, and the underlying card designs, may be subject to copyright or other rights held by third parties. You are solely responsible for ensuring you have the right to upload and use any images and content you submit, and for the accuracy and legality of the listings you create.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.
